Terms of Service

These Terms govern your use of the CREATEAWITY.art iOS app. Please read them carefully — together with our iOS Privacy Policy they form your agreement with us.
1. Acceptance of Terms
Agreement
By accessing or using the CREATEAWITY.art iOS app (the "App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the App.
Eligibility
You must be at least 18 years of age to use the App. By using it, you represent and warrant that you meet this requirement. The App is not intended for, and may not be used by, anyone under 18.
2. Description of Services
The App
CREATEAWITY.art provides AI-powered image editing and generation services, including background removal, image enhancement, style transfer, object removal, and other creative AI tools.
Service Changes
We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where practicable. We will not be liable to you or any third party for any such changes.
Third-Party Services
The App integrates third-party AI models and services. Your use of these integrated services is also subject to the respective providers' terms.
3. Account Registration
Account Creation
You must create an account to access most features. You agree to provide accurate, current, and complete information and to keep it updated.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@createawity.art of any unauthorised access.
One Account Per User
Each user may maintain only one account. Creating multiple accounts to circumvent usage limits or restrictions is prohibited.
4. Credits & In-App Purchases
Credit System
AI image processing in the App consumes credits. Credits are consumed per service use as shown before you generate. Free credits are provided on registration.
Buying Credits — Handled by Apple
Credit packs are purchased as one-time, non-renewing in-app purchases through Apple's App Store, using your Apple ID's payment method. Apple processes the transaction; we never see or store your payment details. Once a purchase is verified with Apple, credits are added to your account. The App does not currently offer auto-renewing subscriptions — every in-app purchase is a one-time credit pack that does not renew and cannot lapse.
Refunds — Handled Exclusively by Apple
All refund requests for App Store purchases must go through Apple, not us. We are unable to issue refunds directly for iOS in-app purchases. To request one, visit reportaproblem.apple.com or use the "Report a Problem" option in your App Store purchase history. Separately, if a generation job fails after credits were charged, those credits are returned automatically to your in-app balance — that is distinct from an Apple purchase refund.
Credit Validity
Credits purchased through the App do not expire while your account remains active and in good standing.
Pricing
Credit pack prices are shown in the App and follow Apple's pricing tiers for your storefront and region, which means the price and the number of credits in a pack may differ from those on our website. We reserve the right to change prices for future purchases at any time; a price change never affects a purchase you have already made.
5. Acceptable Use
Permitted Use
You may use the App for lawful personal, creative, and commercial purposes in accordance with these Terms.
Prohibited Content
You must not use the App to create, upload, or process content that: (a) is illegal or violates applicable law; (b) depicts or promotes violence, abuse, or exploitation of minors; (c) is pornographic or sexually explicit; (d) infringes third-party intellectual property rights; or (e) is defamatory, harassing, or threatening.
Prohibited Conduct
You must not: reverse engineer or attempt to extract our AI models; scrape or bulk-download content via automated means; use the App's services to train competing AI models; resell or sublicense the App's services without authorisation; or attempt to circumvent credit limits or security measures.
Third-Party Content
You must not upload images of other people without their consent, or upload identity documents, financial records, medical records, or biometric data belonging to anyone other than yourself.
Content Moderation
We operate automated and manual content-moderation systems to enforce this policy. We may refuse, block, or remove content that we reasonably believe violates these Terms or applicable law, and will give a reason where it is reasonable to do so.
Compliance
You are solely responsible for ensuring your use of the App complies with all applicable laws in your jurisdiction, including laws regarding image rights, privacy, and intellectual property.
6. Intellectual Property
Your Content
You retain all rights to the images you upload and the outputs you generate using the App. By uploading content, you grant us a limited, non-exclusive licence to process it solely to deliver the services you request.
Our App
All rights to the CREATEAWITY.art app, software, design, trademarks, and brand assets are owned by us or our licensors. These Terms do not grant you any rights beyond the right to use the App as described here.
Generated Outputs
AI-generated outputs are provided for your use. You are responsible for verifying that your use of generated outputs does not infringe third-party rights. We make no warranty that outputs are free of third-party intellectual property claims.
7. Privacy
Privacy Policy
Your use of the App is governed by our iOS Privacy Policy, which covers App Store payment handling and device permissions, and which is incorporated into these Terms by reference.
8. Disclaimers & Limitations
Service Quality
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI outputs will meet your specific requirements.
AI Output Accuracy
AI-generated content is inherently variable. We do not guarantee the accuracy, quality, or suitability of AI outputs for any particular purpose. Review all outputs before use.
Limitation of Liability
To the fullest extent permitted by law, CREATEAWITY.art shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
9. Indemnification
Your Responsibility
You agree to indemnify and hold CREATEAWITY.art, its affiliates, officers, and employees harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) content you upload or generate; (c) your violation of these Terms; or (d) your violation of any third-party rights.
10. Termination
By You
You may terminate your account at any time from the App's Settings or by contacting support@createawity.art. Note that deleting the App from your device does not delete your account or cancel any subscription you may hold on our web platform.
By Us
We reserve the right to suspend or terminate your account immediately, without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our discretion.
Effect of Termination
Upon termination, remaining credits are forfeited and non-refundable except where required by applicable law or through Apple's own refund process. Sections relating to intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
11. Apple-Specific Terms
Scope
Because the App is distributed via the Apple App Store, the following additional terms apply between you, Apple, and us, as required by Apple's App Store Review Guidelines.
Apple Is Not a Party
These Terms are between you and CREATEAWITY.art — not Apple. Apple is not responsible for the App or its content.
No Maintenance Obligation
Apple has no obligation to furnish any maintenance or support services for the App.
Warranty
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
Product Claims
Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
Intellectual Property Claims
Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the App, or your possession and use of it, infringes that third party's intellectual property rights.
Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce these Terms against you as a third-party beneficiary.
Export Compliance
You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
12. Governing Law
Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.
13. Changes to Terms
Updates
We may update these Terms from time to time. We will notify you of material changes via email, in-app notice, or push notification at least 14 days before the changes take effect. Continued use of the App after changes constitutes acceptance of the updated Terms.
